Welcome to PixelCreds.com (the “Site”), operated by Titaneum (UEN: 53501769C) (“PixelCreds”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of the following services (collectively, the “Services”) offered or managed by PixelCreds:

  1. The website PixelCreds.com (the “Site”), along with access to it and all its links and functions;
  2. The purchase of digital products offered via the Site (“Products”);
  3. Payment facilitation services related to Product purchases made via the Site;
  4. User accounts registered via the Site (‘User Accounts’); and/or
  5. Other related applications or services offered by PixelCreds that link to these Terms.

1.2. Acceptance

By accessing the Site or using any of the Services (including purchasing Products), you consent to and accept these Terms, our Refund Policy, and our Privacy Policy, which are incorporated herein by reference. IF YOU DO NOT ACCEPT OR AGREE TO THE TERMS, YOU SHOULD IMMEDIATELY STOP USING AND/OR ACCESSING THE SERVICES.

1.3. Amendments

We reserve the right to amend these Terms at any time without prior notice. Such changes will be effective immediately upon posting the revised Terms on the Site. The “Effective Date” at the top indicates the date of the last revision. It is your responsibility to regularly check the Site for the latest version of the Terms. Your continued use of the Services following any changes shall be deemed continued acceptance of the revised Terms.

1.4. Updates

We may provide new features, upgrades, updates, patches, and other modifications to the Services (collectively, the “Variations”). We may update, patch, or modify the Site or any of our platforms remotely. You hereby grant to PixelCreds the right to deploy and apply such Variations. All provisions of these Terms shall also apply to all such Variations.

2. Use of the Services

2.1. Application of Terms

These Terms shall apply regardless of how you access or use any of the Services, including but not limited to mobile devices, desktop devices, internet browsers, or any other device, application, or software.

2.2. License for Use

PixelCreds grants you a non-exclusive, non-transferable, limited right and license to access and use the Site and/or the Services for your personal and non-commercial use, subject to your compliance with these Terms. PixelCreds reserves the right to terminate this license without prior notice if it is found that your use violates these Terms.

2.3. Access and Use

The Services allow you to browse and select digital Products offered on the Site and make payment for such Products using the available payment channels integrated with the Site (“Payment Channels”). When making payments, any banking or credit card details you provide are collected directly by the relevant Payment Channels (e.g., Stripe or other banking institutions, card issuers, or payment aggregators). These sensitive details are not collected, stored, or processed directly by PixelCreds.

2.4. Payment Authorization and Responsibility

  1. To make payments via the Services, you must use a valid payment instrument issued or recognised by the Payment Channels.
  2. By providing payment information, you represent and warrant that you are the authorized user of the payment method and authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order, including any applicable taxes or fees.
  3. You are fully liable for the use of your selected Payment Instrument in connection with the Services. You acknowledge and accept that PixelCreds has no liability for any unauthorized use or access by third persons of your payment instruments.
  4. PixelCreds and/or the Payment Channels reserve the right and discretion to reject or decline any transaction for any reason or set limits on transaction types and/or amounts.

2.5. Product Information and Availability

We strive to provide accurate descriptions and information about the Products offered. However, we do not warrant that product descriptions, pricing, or other content on the Site are always accurate, complete, reliable, current, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. Product availability is subject to change.

2.6. Modification of Services

PixelCreds reserves the right to change, modify, suspend or discontinue the Services, in part or whole, at any time, with or without notice to you.

2.7. Taxes, Charges, and Fees

You are responsible for any applicable taxes, duties, currency exchange fees (if charged by your payment provider), data charges, and other related charges associated with your purchases made through the Site or Services, which are in addition to the listed Product price.

2.8. Order Confirmation

An order confirmation email or message does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason, including if payment is unsuccessful or if fraudulent activity is suspected.

3. Delivery of Digital Products

3.1. Delivery Process

Upon successful payment confirmation, your order details will typically be transmitted automatically to our third-party provider for fulfillment and delivery directly to the game account details you provided. While we aim for prompt delivery, timelines are estimates and may be affected by factors beyond our control, including provider system status or game server issues. PixelCreds is not liable for delays originating solely from third-party systems, provided the order was correctly transmitted from our end. Risk of loss for purchased Products passes to you upon successful delivery to your specified account.

4. User Obligations and Conduct

4.1. User Responsibilities

By using the Site, you agree to:

  1. Provide true, accurate, current, and complete information as required for purchases and account registration. You are solely responsible for ensuring all information provided during the order process (e.g., User ID, Server) is correct. PixelCreds is not liable for non-delivery or delivery to an incorrect account due to user error (See Refund Policy).
  2. Use the Site and Products for lawful purposes only.
  3. Not engage in any fraudulent transactions or activities.
  4. Not interfere with or disrupt the operation of the Site, servers, networks, or third-party provider systems (including APIs).
  5. Comply with all applicable laws and regulations.

4.2. Pricing and Currency

All prices listed on the Site are in Singapore Dollars (SGD) and you will be charged in SGD, unless otherwise explicitly stated on the relevant product or checkout page. Prices are subject to change without notice. You are responsible for reviewing the final price displayed during checkout before confirming your order.

5. User Declarations and Warranties

5.1. Declarations

By accessing the Site and utilizing the Services, you represent, warrant, and declare that:

  1. Age and Parental Responsibility: You are at least eighteen (18) years of age or the age of legal majority required to form a binding contract in your jurisdiction. If you are under such age (a “Minor”), you declare that you have obtained verifiable permission and consent from your parent or legal guardian to use the Services and make purchases.
    • If you are a parent or legal guardian supervising a Minor using the Services, you hereby agree to: (1) supervise the Minor’s use of the Site and Services; (2) assume all risks, responsibilities, and liabilities associated with the Minor’s use, including any financial obligations incurred through purchases made by the Minor; (3) ensure the accuracy and truthfulness of all information submitted by you or the Minor; and (4) be fully bound by these Terms in respect of the Minor’s access and use.
    • Purchases made by Minors cannot be cancelled or refunded solely on the ground that they were made without the permission, consent, or supervision of a parent or guardian, as such consent and responsibility are assumed under these Terms.
  2. Lawful Use: You will use the Site and Services solely for lawful purposes, in strict accordance with these Terms, and in compliance with all applicable laws, rules, codes, directives, guidelines, policies, and regulations of Singapore and your own jurisdiction.
  3. Authorized Device Use: You are accessing and using the Site and Services on a computer, mobile device, or other machine over which you have ownership or for which you have obtained explicit authorization for such use from the rightful owner.
  4. Authorized Payment Instrument Use: You are solely responsible and liable for the selection and use of any credit card, debit card, e-wallet, or other payment method (“Payment Instrument”) utilized in connection with the Services. You represent and warrant that you are the authorized account holder or have obtained explicit authorization from the account holder to use the Payment Instrument for transactions on the Site. PixelCreds.com shall have no liability whatsoever to you or to any third party for any unauthorized use of your Payment Instruments in connection with the Services.

6. Intellectual Property Rights

6.1. Ownership

All content on the Site, including text, graphics, logos, images, software, and the arrangement thereof, is the property of PixelCreds, Titaneum, or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our express prior written consent.

7. User Accounts

7.1. Eligibility and Registration

To create a user account on PixelCreds.com, you must meet any eligibility requirements specified by us, which may include being at least eighteen (18) years of age or the age of legal majority in your jurisdiction. If you are under the required age, you may only use the service with the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms. You agree to provide true, accurate, current, and complete information during the registration process and to maintain and promptly update such information to keep it accurate, current, and complete.

7.2. Account Security

You are responsible for safeguarding your account password and any other credentials used to access your account. You agree not to disclose your password to any third party. You are solely responsible for any activities or actions taken under your account, whether or not you have authorized such activities or actions. You must notify PixelCreds.com immediately upon becoming aware of any suspected or actual unauthorized use of your account.

7.3. Account Use and Restrictions

You agree to use your account only for lawful purposes and in accordance with these Terms. You may not use another person’s account without their express permission. Creating multiple accounts for deceitful purposes, circumventing these Terms, abusing promotions, or engaging in other disruptive or fraudulent behavior is strictly prohibited.

7.4. Account Suspension and Termination

PixelCreds.com reserves the right to suspend or permanently terminate your account and your access to the Site or Services, at our sole discretion, without prior notice or liability, for any reason, including but not limited to: (a) breaches or violations of these Terms or other incorporated agreements; (b) requests by law enforcement or other government agencies; (c) engagement by you in fraudulent, deceptive, or illegal activities; (d) extended periods of inactivity (e.g., typically 12 months or as determined by us); (e) non-payment of any fees owed by you (if applicable); or (f) unexpected technical or security issues. Termination of your account may result in the forfeiture and destruction of all information associated with it. Sections which by their nature should survive termination shall survive termination.

PIXELCREDS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

11.1. Scope of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TITANEUM, PIXELCREDS.COM, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11.2. Aggregate Liability Cap

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PIXELCREDS EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT PIXELCREDS HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Indemnification

12.1. Your Responsibility

You agree to defend, indemnify, and hold harmless Titaneum, PixelCreds.com, and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site and Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the service caused damage to a third party.

13. Termination

13.1. Termination Rights

We reserve the right, without notice and in our sole discretion, to terminate your right to access or use the Site or purchase Products (and your user account, as detailed in Section 7.4), and to block or prevent your future access, for any reason, including if we believe you have violated these Terms or engaged in fraudulent or illegal activity.

14. Third-Party Services

14.1. External Links and Services

The Site may utilize or contain links to third-party websites or services (e.g., payment processors like Stripe, game publishers, fulfillment providers) that are not owned or controlled by PixelCreds. We are not responsible for the content, policies, or practices of any third-party services. Your interactions with third parties are solely between you and the third party, and may be subject to their own terms and policies.

15. Governing Law and Dispute Resolution

15.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.

15.2. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be attempted to be resolved through amicable negotiations by contacting our support team. If the dispute cannot be resolved through negotiations within thirty (30) days, you are encouraged to approach the Consumers Association of Singapore (CASE) for mediation. If mediation is unsuccessful, the dispute may be referred to the Small Claims Tribunals (SCT) or the courts of Singapore, as appropriate under Singapore law and the rules of such tribunals/courts.

16. Miscellaneous

16.1. Entire Agreement

These Terms, together with the Refund Policy and Privacy Policy, constitute the entire agreement between you and PixelCreds regarding your use of the Site and purchase of Products and supersede all prior agreements or understandings.

16.2. Severability

If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

16.3. No Waiver

Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by PixelCreds.

16.4. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Section headings and sub-headings are for convenience only and shall not affect the interpretation of these Terms.
